My intentions in accepting the invitation to hunt and/or shoot firearms as a guest of BLACKPOWDER PRODUCTS, INC., during this upcoming outdoor adventure are to participate in outdoor recreational activities. Those activities may include, but will not necessarily be limited to, wilderness travel in boats and open skiffs, hunting, fishing, riding of animals, backpacking, climbing and traveling in vehicles. Some or all of such activities may take place in unpopulated, remote places lacking ready access to medical assistance. In the course of engaging in the outdoor recreational activities, there exists a risk of personal injury, illness, death, or property damage from falling, immersion in very cold water, inclement weather conditions, encounters with wild and unpredictable animals, hunting accidents, shooting accidents, etc., with treatment for any injuries or illnesses potentially being delayed due to the absence of medical assistance in remote locations. I recognize that outdoor recreational activities, including but not limited to those described above, can be physically and mentally stressful and pose certain risks and dangers. Recognizing those risks and dangers, including but not limited to those specified herein, I do voluntarily participate in the outdoor recreational activities with BLACKPOWDER PRODUCTS, INC.
I represent that I am in good health with no physical defects that might result in outdoor recreational activities being injurious or causing illness to me, and that I am physically and mentally capable of engaging in outdoor recreational activities which may be associated with the outdoor adventure of which I will be participating as an invited guest of BLACKPOWDER PRODUCTS, INC.
I understand that water or land routes selected, or activities chosen or engaged in with BLACKPOWDER PRODUCTS, INC. may not be the safest and that suchroutes or activities may be selected based upon their interest or challenge, or they may be selected based upon weather or topographical conditions then existing.
Having full knowledge of the foregoing, I hold BLACKPOWDER PRODUCTS, INC. its successors, assigns, shareholders, officers, directors, employees, guides,or agents harmless from and against any claim or liability for any misadventure, injury, illness, death, harm, loss, inconvenience or damage, be it to person or property suffered as a result of participation in any outdoor recreational activities or activities associated therewith.
I assume full responsibility for any death, injuries, illnesses, or damages, be they to person or property, which may occur to me while participating in outdoor recreational activities with BLACKPOWDER PRODUCTS, INC. or in activities associated therewith, and I do fully and forever release BLACKPOWDER PRODUCTS, INC. its successors, assigns, shareholders, officers, directors,
employees, guides or agents from any and all claims, demands, damages, causes of action, be they present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of participation in outdoor recreational activities with BLACKPOWDER PRODUCTS, INC. or in the use of any facilities, equipment, or property owned or used by BLACKPOWDER PRODUCTS, INC.
I understand that the signing of this form acts as a waiver of protection that may be afforded by a statute or law. I also recognize that by signing this form, I am waiving my rights to which I might otherwise be entitled. In spite of this, I have freely and voluntarily signed this form with the intent that it be effective as against myself, any minor children, heirs, executors, personal representatives, agents,
relatives, assignees, or beneficiaries, as well as against anyone else who seeks to make claims against BLACKPOWDER PRODUCTS, INC. I acknowledge that I have read, understand and agree to obey all of the safety rules, if any.
I grant BLACKPOWDER PRODUCTS, INC. its representatives and employees the right to take photographs of me and my property in connection with the above identified subject. I authorize BLACKPOWDER PRODUCTS, INC., its assigns and transferees to copyright, use and publish the same in print and/or electronically.
I agree that BLACKPOWDER PRODUCTS, INC. may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.
THIS DOCUMENT IS INTENDED TO BE A LEGALLY BINDING CONTRACT RELIEVING BLACKPOWDER PRODUCTS, INC. AND ITS SUCCESSORS, ASSIGNS, SHAREHOLDERS, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES AND EMPLOYEES FROM LIABILITY FOR ANY INJURIES, ILLNESSES OR DEATHS. I UNDERSTAND AND ACKNOWLEDGE MY RIGHT
TO CONSULT AN ATTORNEY REGARDING THE CONTENTS HEREOF, BEFORE SIGNING. THIS RELEASE AND WAIVER OF LIABILITY EXTENDS TO ALL CURRENT AND FUTURE PARTICIPATION OF THE UNDERSIGNED IN THE ACTIVITIES WITH BLACKPOWDER PRODUCTS, INC.
